Terms of Service

Last updated 20 April 2026

These Terms of Service ("Terms") govern your use of the Bojanote iOS application and the website at bojanote.app ("the Service"). By installing, launching, or using the Service, you agree to these Terms. If you do not agree, please do not install or use the Service.

2. The Service

Bojanote is a personal reading companion for iOS. It lets you photograph the cover and table of contents of a physical book, uses an AI service to extract the chapter list from that photo, and lets you write one short note per chapter. All of your content is stored in your personal iCloud account via Apple CloudKit.

3. Acceptance by installation

Because the Service has no sign-up and no server-side account, you agree to these Terms and to our Privacy Policy by installing the app and/or by actively using any feature that triggers external processing (in particular, the chapter-extraction feature that sends a photo to OpenAI).

4. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Bojanote for your own non-commercial reading. You may not reverse-engineer, resell, or redistribute the app except as permitted by applicable law or by the Apple Media Services Terms.

5. Your content

The photos, notes, and book entries you create in Bojanote are yours. They are stored in your own iCloud container. We do not claim any rights in them and have no access to them. You are responsible for the legality of the material you photograph and store.

6. AI processing (OpenAI)

The chapter-extraction feature relies on a third-party AI service operated by OpenAI. By using the feature you acknowledge that:

7. Apple CloudKit

The Service uses Apple CloudKit for storage and sync. Your use of iCloud is subject to Apple's terms. We are not responsible for iCloud outages, sync conflicts, or loss of data caused by the iCloud infrastructure. Keeping your own backups is recommended.

8. Acceptable use

You agree not to use the Service to process material you do not have the right to photograph, to attempt to disrupt the Service, to probe or attack the backend, or to abuse the AI processing feature (for example, by submitting content unrelated to book pages).

9. Availability; no warranty

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated chapter lists will be correct.

10. Liability

To the extent permitted by Austrian law, our liability for damages caused by slight negligence is excluded. Liability for gross negligence and intent, as well as mandatory statutory liability (in particular under the Austrian Product Liability Act and for personal injury), remains unaffected. Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.

11. Price and in-app purchases

If the app or any feature is offered for a price, that price and any subscription terms are displayed in the App Store at the time of purchase and handled by Apple. Refunds are governed by Apple's policies.

12. Changes

We may update these Terms — for example, to reflect new features or legal changes. Continued use of the Service after an update constitutes acceptance. The "last updated" date at the top shows the current version.

13. Termination

You may stop using the Service at any time by deleting the app. We may suspend or discontinue the Service, in whole or in part, at any time.

14. Governing law; venue

These Terms are governed by the laws of Austria, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of your country of residence remain unaffected. For disputes with consumers, the statutory place of jurisdiction applies; for merchants, the competent court in Vienna, Austria.

15. Online dispute resolution

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
